Strong Indian siege in Kulbhushan Jadhav case

India very solidly put its stand during the hearing of Indian citizen Kulbhushan Jadhav on Monday in the Great Hall of Justice of Peace Palace in The Hague, the capital city of Netherlands. Putting an immediate ban on death sentence to Jadhav, India said that Pakistan has not only violated the Vienna treaty in this case but the basic human rights also. The Indian counsel Harish Salve also feared that Pak may not hang Jadhav before the judgement of ICJ (International Court of Justice). Salve appealed to the ICJ to hold the decision of Pak martial court as invalid and death sentence be banned. While Pak urged that India is politically using the ICJ. Vienna treaty has no provision for providing diplomatic protocol  to the spy involved in terrorist activities. Pak counsel QC Khabar Quraishi said that India is politically using the ICJ in this case but the ICJ can't interfere in the security of Pakistan. The court should take note of the confession video of Jadhav. It is available everywhere. Jadhav intruded into Pakistan via Iran. Jadhav's confession video is its solid proof. Pakistan had sent the investigation information to India. Pakistan arrested Jadhav in Baluchistan and India was given a copy of the passport which the accused was having but India had no comments on this. The passport had another name of Jadhav. We also sent the copy of FIR lodged on Jadhav and invited India to join this investigation. Pakistan said that Jadhav came to Pakistan after crossing the border of Iran. Pak counted many flaws in the Indian petition and said that Vienna treaty doesn't apply to this case. A bench of 11 judges held the hearing and  said that the decision will come shortly. Before it Pakistan during the hearing wanted to run the video in the court mentioning the said video of confession of Jadhav. But the court didn't allow it. India feared in the court that Jadhav may be hanged before the decision comes.  But Pakistan said that Jadhav won't be hanged till 150 days as he can appeal till 150 days. India talked of Jadhav's right as a citizen, prejudice of Pakistan and threat to the justice. Three judgements were also recited for solidness of the case. Rights of everyone must be respected. ICJ had done so in a German case in 1998. It had ordered the US to ban the punishment of Walter Nile. No decision can be taken on prejudice. It happened so in the case of 44 Mexican citizens arrested in the US. In the case of Finland and the Netherlands, the ICJ had put a ban on the proceedings of Netherlands court on the grounds of threat to justice. Earlier also the Indian citizens have been  jailed in Pakistan or punished on the charges of espionage. The case of Sarabjeet Singh is still known to all. For the first time the Indian government has approached the international court to save its native. Natural justice is must. Ex-Indian Navy officer Kulbhushan Jadhav was neither given a chance to put his plea during the sham trial  in the Pak martial court nor Pak have any solid proof against him. Was Jadhav arrested from Baluchistan or kidnapped from Iran with the help of Taliban? Pak martial court sentenced him to death mere on the grounds of his said confession. Pakistan has alleged that Jadhav is the commander of Indian Navy and was spreading terrorism in Pakistan having a fake identity in Iran. India dismissed these allegations of Pakistan. Jadhav has retired from the Indian Navy and he was kidnapped from Iran. Pakistan and India are face-to-face in the International Court of Justice once again after 18 years. When Pakistan had complained of gunning down a plane by India on 10th of August on 1999, the BJP Government led by Atalji was in power. This time when India has raised the issue, the nation has the BJP Government led by Narendra Modi. Time and again India has exposed but of no effect .Pakistan will once again be exposed in its lie and intentions,the same way it was proved a liar in the very court 18 years ago, it'll be exposed again and Kulbhushan Jadhav will get justice. We are sure Kulbhushan Jadhav will once again return to his country and among the countrymen.
