The Amicus Curiae suggests prosecution against Narendra Modi

The 2002 riots of Gujarat are not going to stop hounding Chief Minister Narendra Modi. Even after getting clean chit from the SIT a few days earlier, a new trouble has raised its head. The Amicus Curiae appointed by the Supreme Court has suggested that Modi can be tried under various IPC sections for inciting enmity within different communities during the 2002 riots. The report by Raju Ramachandran on the complaint by Zakia Jafferey is completely different from that of the SIT appointed by the Court. Earlier, the SIT had given clean chit to Modi and others. Expressing his opinion, the Amicus Curiae Ramachandran, in his report, has said that Modi can be prosecuted under sections 153a(1) (A) and (B) of the IPC, which relate to creating enmity among various communities on the basis of religion. He should also be tired under section 166. In its report, the SIT had rejected the allegations leveled by the suspended IPS officer, Sanjeev Bhatt that in view of Godhra incident of 27th February 2002, Modi had directed that let Hindus be allowed to vent their anger against Muslims and teach them a lesson. Bhatt has filed an affidavit in this regard before the Supreme Court. The SIT had handed over its report on Gulbarga Society riot to Zakia Jafferey. In the riots that followed the Godhara episode, 69 persons were killed, including Zakia's husband and former MP, Ehsan Jafferey. According to the Supreme Court Advocate, DK Garg, Zakia could base her plea in the High Court on this report of Amicus Curiae. After the refusal by the lower Court, this report is enough to support her case. The Congress Spokesperson, Manish Tiwari said that Modi cannot escape the truth that he was responsible for the massacre that followed the Godhara riots. Meanwhile, BJP leader, Arun Jaitley is of the opinion that there is no place for any advocate or amicus curiae under the IPC or under the Evidence Act and investigation is the responsibility of the Police not that of any advocate. BJP has come out in open to support Narendra Modi on the basis of the SIT report. BJP has said that Congress and some so-called activist organizations have started a campaign
against Narendra Modi to tarnish his image. At last, truth has prevailed. Javdekar said that since the SIT was constituted by the Supreme Court and there was no representative of the Gujarat Government on this team, therefore is has assumed great importance. Javdekar has asked, why the Congress, which is raising its eye-brow on Gujarat riots, had failed to get the rioters of 84-riots punishe, whereas the guilty of Gujarat riots have been punished and are still being punished. The Congress is tarnishing the image of Gujarat in the world without any reason.
